Town of Fort Frances Recreation Activities Waiver and Assumption of Risk

Recreation Activities

This waiver applies to participation in recreation activities offered by the Town of Fort Frances, including but not limited to:

  • Public skating
  • Shinny hockey
  • Recreational hockey
  • Walking track activities
  • Fitness activities
  • Drop-in recreation programs
  • Registered recreation programs
  • Other activities taking place in Town recreation facilities

Acknowledgement of Risk

Participation in recreation activities involves inherent risks that cannot be completely eliminated.

These risks may include, but are not limited to:

  • Falls and slips
  • Collisions with other participants or objects
  • Contact with sports equipment
  • Ice, floor, facility or weather-related conditions
  • Equipment malfunction or failure
  • The actions or negligence of other participants

Participation may result in personal injury, illness, property damage, permanent disability, or death.

I acknowledge that I understand these risks and choose to participate voluntarily.

Assumption of Risk

I freely accept and assume all risks associated with participation in Town recreation activities, whether those risks are foreseen or unforeseen.

I acknowledge that I am responsible for determining whether I, or my child, are physically capable of participating safely.

Release of Liability

In consideration of being permitted to participate in Town recreation activities, I agree to release and hold harmless the Town of Fort Frances, its Council, employees, volunteers, contractors, agents, and representatives from claims, demands, actions, damages, losses, or liabilities arising from participation in recreation activities, except where prohibited by law.

Participant Responsibilities

Participants agree to:

  • Follow all posted rules and regulations.
  • Follow all directions provided by Town staff.
  • Use equipment and facilities responsibly.
  • Refrain from participating when injured, ill, or impaired.
  • Conduct themselves in a safe and respectful manner.

Parents and Guardians

Where the participant is under 18 years of age, the parent or legal guardian acknowledges and accepts these risks on behalf of the participant and consents to the participant's involvement in Town recreation activities.

Electronic Agreement

By submitting the Town of Fort Frances Recreation Waiver Form and entering an electronic signature, participants or parents/guardians acknowledge that:

  • They have read and understood this waiver.
  • They agree to its terms.
  • The electronic signature is legally binding and has the same effect as a handwritten signature.

Term of Waiver

  • Adult waivers remain valid for three (3) years from the date of submission.
  • Youth waivers remain valid until August 31 following submission unless otherwise specified by the Town.
  • The Town reserves the right to update or replace this waiver at any time.
